1. The Company does not accept liability for any delays or increased costs caused by any act of God, force majeure, strikes, lockouts, riots, Government order, accidents, machinery breakdowns or other causes beyond our control.
2. We accept no complaint of any kind unless it is made in writing within 7 days after the time of supply of the materials or goods of which complaint is made. The Company’s liability on goods found and agreed to be defective is confined to free replacement only. The Company shall have no liability whatsoever for any losses or damages which may be sustained by the Customer because of non delivery in due time or at all, part delivery, mis-delivery or delivery of defective goods howsoever caused.
3. Customers should ensure that goods are to be unloaded immediately on arrival. A maximum of 60 minutes is allowed for arriving, unloading and leaving. Any excess time will be charged at the current ruling hourly rate.
4. We do not undertake to deliver any load over roads or other ground which we consider to be unsuitable. If a vehicle used for performing our delivery is instructed by site to a place situated off a hard roadway, the customer is to be solely responsible for any damage resulting in consequence.
5. Time of delivery is not guaranteed. Any delivery schedule requested and given for delivery of goods is given or agreed by the Company in good faith and every endeavour will be made to comply herewith. The Company shall not, however, be liable for any loss consequential or otherwise arising through its failure to make delivery by the due date or time.
6. Extra charges will be applied to deliveries of customer orders that are less than a full lorry load or are required to be made outside normal working hours.
7. The company reserves the right to make a charge for its costs for any load that is refused on site through no fault of the company.
8. In the event of the customer not taking delivery of any product that is a Made To Order product the Company reserves the right to charge for same.
9. We reserve the right to refuse or suspend deliveries of any orders where arrangements for payment are unsatisfactory.
10. Ownership of goods shall pass only following full payment. If the goods are sold by the customer before they have been paid for, then Broome Bros (Doncaster) Ltd have right to the proceeds of the sale.
11. Goods shall be at the Customers risk in the period between delivery and payment.
12. Payment shall be made within 28 days of the last day of the calendar month in which the goods were delivered
13. The price charged will be the price ruling at the time of delivery and, after pre-notified periodic price increases, may not necessarily reflect a previously quoted rate.
14. Any variation to these Conditions must have the written approval of the Company.
